Improper Parking

In Florida, you can receive a parking citation for a variety of improper parking activities. These include, but are not limited to:

  • Parking in a space designated for disabled persons
  • Parking on a sidewalk or crosswalk, in an intersection, on a railroad track, or on a bicycle path
  • Parking anywhere where there is a sign stating parking there is prohibited
  • Parking more than 12 inches away from the curb

The above improper parking violations are generally cited as a noncriminal nonmoving traffic violation and incur a $30 fine plus court costs and administrative fees. These improper parking violations do not result in points being added to your driving record.

Some Parking Violations are Moving Violations

It is a noncriminal moving violation to park, stop, or leave a car - unattended or attended - on a highway outside of a municipality if it is practical to park, stop, or leave the vehicle off the paved or traveled part of the highway. This, of course, does not apply to those vehicles that are disabled or otherwise unable to move off the roadway, or where there is no place off the roadway on which to move the vehicle.

However, because parking or stopping on a highway is considered a moving violation, if you are cited under this statute, you face a fine of at least $100 plus other administrative and court costs and three points on your driving record.
