Marijuana Possession

Marijuana possession in Florida is treated as a serious crime.  The punishment you face depends on the amount you were caught with or are accused of possessing.  The penalties are as follows:

  • Less than 20 grams or possession of drug paraphernalia: misdemeanor of the first degree, punishable by imprisonment up to one year and a fine up to $1,000
  • More than 20 grams: felony of the third degree, punishable by imprisonment up to five years and a fine up to $5,000

Possession of Cocaine, Heroin, and Other Drugs

The penalties for possession of other controlled substances including cocaine, heroin, and ecstasy are even more severe than those for marijuana possession.  The punishments are as follows:

  • Less than ten grams: felony of the third degree, punishable by imprisonment up to five years and a fine up to $5,000
  • More than ten grams: felony of the first degree, punishable by imprisonment up to 30 years and a fine up to $10,000
